These terms apply to your use of altitudexeriscape.com and to services provided by Altitude Xeriscape ("we," "us" or "our"). By using this website or hiring us, you agree to these terms.

1. Estimates and quotes Estimates are free. Written quotes are based on the information and site conditions available at the time and are valid for 30 days. Prices may change if the project scope, materials or site conditions change. Any changes will be agreed with you before work continues.

2. Scheduling Project start dates are estimates and can be affected by weather, material availability and permit or utility requirements. We will keep you informed of any delays.

3. Deposits and payment A 50% deposit is required to schedule your project and order materials. The remaining 50% is due upon completion. We accept check, credit card, Zelle and Venmo. Late payments may be subject to a 5% fee after 3 days.

4. Property access and utilities You agree to give us reasonable access to the work area and to clear it of vehicles, pets and personal items. We will request utility line locates through Colorado 811 before digging. We are not responsible for damage to private, unmarked lines such as sprinkler lines, invisible pet fences or low-voltage lighting that were not disclosed to us.

5. HOA and city approvals You are responsible for obtaining any HOA approvals for your project. If a city permit or program approval is required, such as for a water utility rebate, we can help you understand the requirements, but approval and rebate payments are decided by the program, not by us.

6. Plant guarantee Plants are living materials, and their health depends on proper watering and care. At the end of every project, we give you written watering and care instructions.

• Spring and summer installations: plants are guaranteed for 90 days from the date they are planted.
• Fall installations (September 1 through November 30): plants are guaranteed through May 31 of the following year, so we can assess them together after winter.
• What qualifies: a plant we supplied and installed that, during its guarantee period, is dead or has lost more than half of its living growth and is not expected to recover. Plants that are dormant for the season, such as perennials and ornamental grasses in winter, do not qualify until they have had a chance to green up in spring.
• Replacement: we replace each qualifying plant one time, including labor, at no charge. Replacement plants are not covered by a new guarantee.
• What's covered: during the guarantee period, failures caused by our plant selection, plant quality or installation, including installation errors.
• What's not covered: failures caused by improper or insufficient watering, not following our care instructions, animal or pest damage, extreme weather events such as hail or record cold, or changes made by others.

7. Workmanship warranty We warrant our installation workmanship for 1 year from completion. This covers defects in our installation, not normal settling, wear, weather events or changes made by others.

8. Snow removal Snow removal services are provided on a seasonal basis and begin when snowfall reaches 2 inches. We work to keep surfaces safe but cannot guarantee ice-free conditions at all times. Please report any ice concerns to us promptly.

9. Cancellations If you cancel after materials have been ordered, the deposit may be kept to cover materials and costs already incurred.

10. Photos of our work We may photograph completed projects for our website and social media. We never share your name or address. Let us know if you prefer we not photograph your property.

11. Website use The information on this website is for general purposes only and may change without notice. Photos, text and graphics on this site belong to Altitude Xeriscape and may not be copied without permission. Links to other websites are provided for convenience; we are not responsible for their content.

12. Limitation of liability To the extent allowed by law, Altitude Xeriscape is not liable for indirect or consequential damages arising from use of this website or our services. Our total liability for any project will not exceed the amount paid for that project.

13. Governing law These terms are governed by the laws of the State of Colorado.
